H.Res. 961– Rule providing for consideration of H.R. 2083 – Endangered Salmon and Fisheries Predation Prevention Act (Rep. Herrera Beutler – Natural Resources) andH.R. 6157 – Department of Defense Appropriations Act, 2019 (Rep. Granger – Appropriations)(One hour of debate).  The Rules Committee has recommended one Rule which would provide for consideration of two bills.

For H.R. 2083, the Rules Committee has recommended a structured Rule that provides for one hour of general debate equally divided and controlled by the Chair and Ranking Member of the Committee on Natural Resources.  The Rule provides for consideration of 3 amendments, debatable for 10 minutes, equally controlled by the proponent and opponent of the amendment. The Rule allows one motion to recommit, with or without instructions, and waives all points of order against the legislation. 

For H.R. 6157, the Rule provides for one hour of general debate, equally divided between the Chair and Ranking Member of the Committee on Appropriations. The Rule provides for consideration of 24 amendments, each debatable for 10 minutes, equally controlled by the proponent and opponent of the amendment.

The Rule also provides that the Chair and Ranking Member of the Committee on Appropriations or their respective designees may offer up to ten pro forma amendments each at any point for the purpose of debate.

A second Rule providing for additional amendments to H.R. 6157 is expected to be considered on the Floor tomorrow.  Members are urged to VOTE NO.

H.R. 2083– Endangered Salmon and Fisheries Predation Prevention Act (Rep. Herrera Beutler – Natural Resources) (One hour of debate).  The bill amends the Marine Mammal Protection Act of 1972 to streamline the permitting process to allow the states of Oregon, Washington, and Idaho and several Pacific Northwest Indian tribes to use lethal “take” of pinnipeds (sea lions and seals) in the Columbia river and its tributaries in order to protect several species of endangered or threatened salmon.  Proponents of the bill argue that it is necessary to reduce the predation of endangered or threatened species of salmon in the region and support a habitat where they can increase in numbers by limiting the sea lion and seal populations.

Opponents of the bill contend that predation of salmon by sea lions and seals represents only a small portion of the challenges facing these threatened or endangered salmon species in the Lower Columbia River. Dams, pollution, habitat loss, climate change, and non-native fish competing for resources are also significant factors impacting the recovery of these listed salmon species, and H.R. 2083 does nothing to address those issues.  
 
The Rule provides for one hour of general debate and provides for consideration of 3 amendments. The amendments are:
 
Kilmer/Heck Amendment.  Limits the application of the bill to only sea lions, rather than all pinnipeds.
Huffman Amendment.  Substitute Amendment that also seeks to protect endangered and threatened salmon and prevent predation by sea lions through deterrence, limited removal measures, and lethal taking after completing a process.
Vargas Amendment. Requires the Secretary of the Interior produce a report to Congress on the potential impact of the lethal taking of California Sea Lions on the recovery of Salmonid stocks.

Begin Consideration of H.R. 6157Department of Defense Appropriations Act, 2019 (Rep. Granger – Appropriations)(One hour of debate).  H.R. 6157 appropriates $606.5 billion in FY2019 base discretionary budget authority for the Department of Defense – plus an additional $68.1 billion in discretionary budget authority designated for Overseas Contingency Operations (OCO).  These funding levels are consistent with the recent budget agreement that raised the Budget Control Act (BCA) spending caps, which increased the FY2019 defense cap by $85 billion, and allowed an additional $69 billion in OCO.

The measure includes a military pay raise of 2.6%.  Also, the bill continues provisions prohibiting the transfer of Guantanamo detainees to the U.S or closure of the facility. It also includes funding for sexual assault prevention and response programs in the military and suicide prevention and outreach programs.

The Rule provides for one hour of general debate and makes in order the first 24 amendments.  A full list of amendments can be found HERE.

The GOP Leadership has announced the following schedule for Wednesday, June 27: The House will meet at 12:00 p.m. for legislative business.  The House is expected to continue consideration of H.R. 6157 – Department of Defense Appropriations Act, 2019 (Rep. Granger – Appropriations) (Subject to a Rule).  The House is also expected to consider bills listed for consideration under suspension of the Rules.  Members are advised that additional legislative items are expected.
